Fusinity Ltd licence AGREEMENT

  1. This licence AGREEMENT is between Fusinity Ltd ("Fusinity"), and the Individual or Organisation ("licensee") accessing and otherwise using EmSnoop software and its associated documentation.
  2. Limitations on the expiry date, licensed users, workstations or domains for non-demo versions are as agreed separately and controlled by the licence file provided. The licensee agrees not to circumvent the restrictions agreed and imposed by the licence file.
  3. You may not reverse engineer, decompile, or disassemble EmSnoop, nor attempt in any other manner to obtain the source code.
  4. Fusinity is making EmSnoop available to licensee on an "AS IS" basis. FUSINITY MAKES NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED. BY WAY OF EXAMPLE, BUT NOT LIMITATION, FUSINITY MAKES NO AND DISCLAIMS ANY REPRESENTATION OR WARRANTY OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE OR THAT THE USE OF EMSNOOP WILL NOT INFRINGE ANY THIRD PARTY RIGHTS.
  5. FUSINITY SHALL NOT BE LIABLE TO LICENSEE OR ANY OTHER USERS OF EMSNOOP FOR ANY INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES OR LOSS AS A RESULT OF MODIFYING, DISTRIBUTING, OR OTHERWISE USING EMSNOOP, OR ANY DERIVATIVE THEREOF, EVEN IF ADVISED OF THE POSSIBILITY THEREOF.
  6. The licensee accepts that EmSnoop is not validated to high-integrity standards and that it exchanges messages on communication buses and requests changes to internal memory states in embedded systems. These operations can have unexpected and undesirable consequences which depend on the licensee’s use of the program and licensee accepts all responsibility for such consequences, even if EmSnoop operated incorrectly.
  7. Fusinity Ltd reserves all rights to EmSnoop. It may not be distributed without the prior agreement of Fusinity Ltd.
  8. This licence Agreement will automatically terminate upon a material breach of its terms and conditions.
  9. Nothing in this licence Agreement shall be deemed to create any relationship of agency, partnership, or joint venture between Fusinity and licensee. This licence Agreement does not grant permission to use Fusinity trademarks or trade name in a trademark sense to endorse or promote products or services of licensee, or any third party.
  10. By copying, installing or otherwise using EmSnoop, licensee agrees to be bound by the terms and conditions of this licence Agreement.
